Frequently Asked Questions
Include three details in every contract:
- The chosen Incoterm (e.g., FCA, DDP)
- The version (Incoterms 2020)
- The exact delivery location (not just the city—include address and unloading bay if possible)
If you only specify the Incoterm in your contract and not the version, the latest ICC published guidance rules (Incoterms 2020) will apply by default.

Start by understanding what each Incoterm means for cost and risk. Before signing an international contract, confirm who pays for transport, insurance and duties. Select the term that best matches your shipping method and business needs. For example, free carrier (FCA) often works better than Ex Works (EXW) because it clarifies the loading responsibilities of the exporter. Always document the agreed Incoterm, version and delivery point in writing.

Common errors include using free on board (FOB) for inland transportation, failing to specify the delivery point and assuming Incoterms cover title transfer. Incoterms define when risk transfers from seller to buyer. For example, under free on board (FOB), risk shifts once goods are loaded on the vessel; under delivered duty paid (DDP), the seller carries shipping risk until delivery at the buyer’s location. Knowing this helps you decide who should arrange insurance and at what stage.
Originally recorded in 2024, the content is still current as Incoterms 2020 will be in effect until approximately 2030.
Incoterms are revised every 10 years, with the latest version coming into effect Jan. 1, 2020. If your sales contract was created before that date, Incoterms 2010 rules would apply.
